1. Acceptance of Terms
By accessing or using the Energy Intelligence website at https://energyusage.my and any related services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.
These terms apply to all visitors, users, and others who access or use the Services, including prospective clients requesting demonstrations and subscribed facility customers using the energy monitoring and control platform.
2. Description of Services
Energy Intelligence by Unarvu AI provides an AI-powered energy monitoring and control system designed for healthcare, hospitality, commercial, education, industrial/manufacturing, and smart city facilities. Our Services include:
- Real-time energy monitoring of electricity, water, gas, thermal, and HVAC systems
- Maximum Demand monitoring and remote control to manage peak charges
- Energy utilisation analytics and reporting dashboards
- AI-powered insights and anomaly detection
- Threshold alerts and predictive maintenance scheduling
- Compliance reporting for ESG and EECA standards
- Integration APIs for BMS, SCADA, and facility information systems
- Professional implementation and ongoing technical support
Services are provided on a subscription basis, with terms detailed in the applicable Service Agreement signed between Cre8 IOT Sdn Bhd and the subscribing facility.
Where Services include remote control of HVAC or Maximum Demand systems, control actions are executed only according to thresholds, schedules, and rules authorised in advance by the subscribing facility's administrator. The facility remains responsible for verifying that control actions are appropriate for its operational and safety requirements.
3. User Accounts and Obligations
To access certain features of the Services, you may be required to create an account or be provisioned one by your organisation's administrator.
You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorised access or security breach
- Use the Services only for lawful purposes and in accordance with applicable regulations
- Not attempt to reverse engineer, decompile, or extract source code from the platform
You are responsible for all activity that occurs under your account.
4. Intellectual Property
All content, software, designs, logos, trademarks, and proprietary technology associated with Energy Intelligence and Unarvu AI are the intellectual property of Cre8 IOT Sdn Bhd and are protected by Malaysian and international copyright, trademark, and patent laws.
You are granted a limited, non-exclusive, non-transferable license to use the Services solely for your internal business purposes during the term of your subscription. This license does not grant you any right to:
- Copy, modify, distribute, or create derivative works of our platform
- Remove any copyright, trademark, or proprietary notices
- Use our trademarks without prior written consent
- Sub-license, sell, or transfer access to the Services
5. Disclaimer of Warranties
Our website and services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the website will be error-free or uninterrupted.
Energy data, analytics, and automated control actions provided by our platform are for informational and decision-support purposes. Clients are responsible for verifying critical decisions and control thresholds with appropriate engineering and financial review.
6. Limitation of Liability
To the maximum extent permitted by law, Cre8 IOT Sdn Bhd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website or services.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
8. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
